The SERVICES are defined as the Enchanted Diamonds website and order facilitation between you and the Enchanted Diamonds for the jewelry listed on www.EnchantedDiamonds.com.
ALL DIAMONDS AND PRODUCTS ARE SUBJECT TO AVAILABILITY.
Please read the following terms and conditions carefully, as this Terms of Use and Services Agreement sets forth the standards of use between Enchanted Diamonds (“Enchanted Diamonds” or “we”) and you (the “User”). If you do not agree to these terms and conditions, you may not use the website or the Services and should not proceed to use the website or the Services – please leave the Enchanted Diamonds website. By using the Services after the Effective Date above, in other words by viewing and using the Enchanted Diamonds website and/or using the Enchanted Diamonds website in order to place an order with Enchanted Diamonds, the User agrees to these terms and conditions, including all amendments made to date. Again, if the User does not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website and Services. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Subject to compliance with this Terms of Use and Services Agreement, Enchanted Diamonds is providing Users with a listing on its website, via its proprietary Software, of various diamonds, ring settings, and other gemstones. You have the opportunity to use the proprietary Software on the Enchanted Diamonds website in order to build your own jewelry. By making a purchase from Enchanted Diamonds.com, you understand and agree that Enchanted Diamonds may share information about you and your transaction with other companies for the purpose of processing your transaction, including fraud prevention, vendor direct shipping and credit card authorization. Please review our Privacy policy . Local taxes, if applicable, will be added to your order. Enchanted Diamonds collects sales tax for all states and the District of Columbia, except for Delaware, Montana, New Hampshire and Oregon.
You acknowledge and agree that some pictures of items on the Enchanted Diamonds website may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may be represented at a larger than actual size in order to clearly show details, or smaller than actual size in order to show the entire item. These pictures are intended to represent the general design and appearance of the item. They are not intended as an actual picture of the piece that will be shipped. Enchanted Diamonds is not responsible or liable for any variation in size of the actual ordered or purchased piece of jewelry, diamonds or gemstones based on the picture on the website. Further, the Enchanted Diamonds website may contain typographical errors or inaccuracies and may not be complete or current. Enchanted Diamonds therefore reserves the right to correct any errors, inaccuracies or omissions (including after an order has been submitted) and to change or update information at any time without prior notice. Please note that such errors, inaccuracies or omissions may relate to pricing and availability, and Enchanted Diamonds reserves the right to cancel or refuse to accept any order placed based on incorrect pricing or availability information. Lab Certificates/Grading Reports/Appraisal
We are proud to offer the finest quality diamonds available in your price range. While aspects of diamond grading are subjective, a diamond Grading Report from the Gemological Institute of America (GIA) or the American Gem Society (AGS) will accompany our loose diamond inventory. If you wish to have your jewelry examined by another laboratory or grading entity, Enchanted Diamonds disclaims all responsibility for those results. Further, Enchanted Diamonds is not responsible for possible dissimilarities and/or differences that could appear from repeated examinations or appraisals of the jewelry or diamonds purchased, as a result of other methods applied by a subsequent appraiser.
Articles warranted by Enchanted Diamonds as eligible for return, credit, or exchange in the U.S. if returned in saleable condition within 15 days, accompanied by a sales receipt. All returned jewelry will be examined and inspected upon return by Enchanted Diamonds. Any returned jewelry not in original condition and/or packaging, showing signs of wear, or that have been personalized with engraving cannot be accepted for return. Return authorization must be provided by an Enchanted Diamonds Represenative who will provide labels and return instructions along with a return authorization number. RETURNS MUST BE CALLED INTO AN ENCHANTED DIAMONDS REPRESENATIVE. RETURNS WILL NOT BE ACCEPTED IN ANY OTHER CIRCUMSTANCES OR FASHIONS.
A refund, if eligible, will be made to the purchaser upon request if payment has been received. To return or exchange your gift selection, please follow the instructions included with your package.

User agrees to indemnify and hold Enchanted Diamonds, its parents, subsidiaries, affiliates, officers, managers, members and employees, agents, and contractors harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of User’s use of the Services, the violation of this Agreement, or infringement by User, or other user of the Services using User’s computer, of any intellectual property or any other right of any person or entity.
Enchanted Diamonds retains all ownership of the content on the Enchanted Diamonds website, and all ownership of the copyrights, patents, trademarks, trade secrets and know how associated with the Services. User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell in any way any information, documents, graphics, software, products or services obtained from Enchanted Diamonds’ Services or its website. User recognizes that he/she may not reverse engineer, or reverse assemble the Services, Enchanted Diamonds’ website software, or otherwise attempt transfer of any right in the software. User recognizes that unauthorized use of website content may subject said user to civil or criminal liability.
Enchanted Diamonds reserves the right to modify or discontinue the Services with or without notice to the User and to cancel any jewelry order at any time. Enchanted Diamonds shall not be liable to User or any third party should Enchanted Diamonds exercise its right to modify or discontinue the Services or for the cancellation of an order. User acknowledges and accepts that Enchanted Diamonds does not guarantee continuous, uninterrupted or secure access to its website and operation of the website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. User understands, acknowledges and agrees that Enchanted Diamonds is not responsible for the availability of, or the content located on or through, any third-party site and User hereby releases Enchanted Diamonds of any liability regarding such third party sites and their services. If User is accessing the Services via the Enchanted Diamonds website, User acknowledges that like any web application, the Enchanted Diamonds website may be susceptible to hacker attacks and security breaches. It is the User’s responsibility to ensure that the servers and computers using the Services are in a secure environment with appropriate firewalls, database encryption, virus protection, security patches including windows update in place. Enchanted Diamonds is not liable for any loss of data or any other damages from security breaches, denial of service or other hacker attacks.

The Services and any claim related to the website are subject to the laws of the State of New York, and such laws will govern this Terms of Use and Services Agreement, without giving effect to any choice of law rules. We make no representation that our website or other services are appropriate, legal or available for use in other locations. Accordingly, if User chooses to access our website you agree to do so subject to the internal laws of the State of New York.
Any action against Enchanted Diamonds in connection with this Terms of Use and Services Agreement and the Services must be brought within 12 months after the cause of action arises. In all events, we each waive trial by jury. In any proceeding to enforce the terms hereof, the prevailing party shall be entitled to recovery of an attorney fee, in addition to other costs of suit.
User assumes all knowledge of applicable law and is responsible for compliance with any such laws. User may not use the Services in any way that violates applicable state, federal, or international laws, regulations or other government requirements. User further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.

User agrees that this Terms of Use and Services Agreement and any other agreements referenced herein may be assigned by Enchanted Diamonds in our sole discretion. This Terms of Use and Services Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a User. User agrees that by accepting this Terms of Use and Services Agreement, User is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement. No clause of this Terms of Use and Services Agreement will be deemed waived, and no breach of this Terms of Use and Services Agreement excused, unless the waiver or consent is in writing signed by the party granting such waiver or consent. Waiver of the breach of any provision of this Term of Use Agreement will not operate or be construed as a waiver of any other or subsequent breach.
